Topic: Meet and Confer Checklist

This presentation will cover the information you need to have at hand to successfully represent your client at the Meet and Confer Conference. Ms. Fessler will provide a checklist to follow when preparing for and participating in the conference. Anticipating areas of controversy and understanding key areas of collaboration is critical when approaching the conference. From suggested keywords, agreed upon search methodology, and forward onto production specifics, it is ever more important to be well versed and well prepared.

Speaker: Heidi J.K. Fessler


Heidi J.K. Fessler is of counsel in Barnes & Thornburg’s Minneapolis office and a member of the Litigation Department and the eDiscovery, Data and Document Management Practice Group. Ms. Fessler concentrates her practice on discovery and data related issues, cyber and data security, and internal investigation services. In addition, Ms. Fessler acts as designated national discovery counsel for a large healthcare organization where she works with the organization, external merits counsel and in-house counsel to create defensible and cost-effective discovery practices.

With nearly 25 years of experience as an attorney and as a data management consultant, Ms. Fessler counsels clients in data security and data breach incident response, internal investigations, risk management, litigation readiness planning, information governance policies and strategies. She has worked with a broad range of financial services clients to address their data management practices as well as to coordinate complex discovery projects within both individual and MDL matters. She also assists clients with program training and implementation and information management technology selection.

Ms. Fessler has worked with corporate clients to review, create and implement data and information management policies and processes; facilitate collection of data for employment, business litigation and internal investigative matters; and develop data breach and privacy incident response planning and implementation strategies.

Active in the community, Ms. Fessler is a member of the Minnesota Women Lawyers and serves as the co-chair of the Seasoned Women Lawyers. She is also a member of the Sedona Conference Working Group Series and Minnesota eDiscovery Working Group. Ms. Fessler is a frequent speaker and author on e-discovery, information management and legal technology topics.

Ms. Fessler earned her J.D. from Rutgers University School of Law in 1991 and her B.A., magna cum laude, from the University of Wisconsin in 1987. In addition to being admitted to practice in Minnesota and Pennsylvania, Ms. Fessler is admitted before the U.S. District Court for the District of Minnesota.
