Topic: Reviewing Title Commitments and Surveys

In this Sectional we will go over the Importance of title and survey review, the historic overview and the changes that have taken place.

Review of the following:

  • Minnesota Statutes § 507.34
  • Lucas v. Independent School District No. 284, 433 N.W.2d 94, 97 (Minn. 1988).  
  • Wertheimer v. Byrd, 153 N.W.2d 252, 253 (Minn. 1967).
  • minimum detail requirements ere most recently revised in 2016.

Tom Bray is a member of the firm's Real Estate section and practices principally in the

Commercial Real Estate

Tom has more than 25 years’ experience representing both corporate and individual clients in all types of real estate acquisition, financing, development and sale transactions. He has significant experience in the acquisition and development of land for commercial, residential and mixed use condominium and planned community projects, including condominium conversions. Tom also participated in the drafting of the Minnesota Common Interest Ownership Act and its subsequent amendments.

As a complement of his practice, Tom works closely with the public finance team and often serves as special counsel to cities and municipal  development authorities in connection with commercial real estate development projects.

Commercial Leasing: Tom represents both landlords and tenants with all types of commercial leasing arrangements involving office, retail and industrial property.

Workouts and Foreclosures: In his work with lenders and creditors, Tom has been involved in numerous workouts and foreclosures including, most recently, numerous foreclosures of land acquisition mortgages and construction mortgages on partially developed single-family residential and residential condominium projects.

Community Activity: Tom actively assists a local nonprofit housing provider with issues relating to residential development and condominium construction. He also provides pro bono real estate counsel to an organization serving veterans. Tom is active in the Real Property Law Section of the Minnesota State Bar Association. He is a past chair of the Section and remains a member of the Section's governing council.
