Topic: Custody and Guardianship: Similarities and Differences
The terms “custody” and “guardianship” are sometimes confused.
Parents are deemed the “natural guardians” of their children under the age of 18. When a child reaches the age of 18, they are typically an independent adult person with the authority to independently make decisions for themselves.
What happens when a child’s ability to make and carry out decisions for themselves is approaching the age of 18 (also called the “age of majority”)? In those situations, it is common for parents to investigate and possibly pursue being appointed their adult child’s guardian.
This presentation will inform the attendees about the following:
1) How is custody similar to guardianship?
2) How are custody and guardianship different?
3) Possible alternatives to guardianship.
4) Considerations in determining whether guardianship should be pursued.
5) The process of obtaining guardianship.
6) Ongoing responsibilities of guardians.

Patricia Buss was licensed as an attorney in 1981. Since that time, she has practiced in the areas of criminal prosecution, paternity and child support, mental health and chemical dependency commitments, guardianship/conservatorship and vulnerable adult, child protection, and family law.
Since 1996, her practice has focused on the areas of guardianship/conservatorship and family law.
