Topic: Contemporary Approaches to Mobile Devices, Ephemeral Messaging, Cloud Storage, and Generative AI

The popularity and usage of mobile device applications and cloud-based collaboration and storage platforms has grown immensely in recent years in large and small businesses alike. The ability to connect a workforce through collaborative software has helped to increase operational efficiency, organization, and scalability. At the same time, an adverse relationship with legal discovery has occurred; these applications and systems are usually cloud based, cannot be collected with traditional forensic tools, and often export data in formats that are problematic for discovery review platforms. Furthermore, many of these platforms are ephemeral by design, meaning that data retention is challenging, if not impossible. This presentation will discuss cutting-edge approaches to discovery collections and review from mobile devices and cloud platforms. Topics we will cover include defensible mobile device acquisition, mobile device legal review options, ephemeral messaging applications, and how to defensibly obtain data from cloud-based platforms like Slack, Jira, Confluence, Salesforce, Zendesk, and the like.

Speakers: Stephen Gresch, Brandon Rimnac, Matthew Samet

Stephen Gresch: 

Director of Forensic Technology and Consulting for TransPerfect Legal. Digital Forensics and eDiscovery professional with fourteen years of data analytics and computer laboratory experience. Provides advisory services for clients, develops strategy and executes projects related to digital forensics, investigations, and eDiscovery. Comprehensive knowledge of industry-standard forensic tools used for data collection, evidence processing, and analysis. An expert in evidence collection, chain of custody, and secure evidence storage. Creates and administers internal training seminars for Forensic Technology and Consulting department. Dedicated to strict procedural guidelines with an emphasis on accurate documentation and reporting protocols. Prior to joining TransPerfect, worked in eDiscovery processing Electronically Stored Information, developing workflows, and training team members in tools and procedures. Worked with multiple data processing tools and hosting platforms, giving a wide view on the lifespan of forensically acquired evidence and Enterprise data review.

Brandon Rimnac:

Mr. Rimnac has over 15 years’ experience in the Legal Technologies industry and has consulted law firms, corporations, and government agencies through extraordinarily complex cases. He has traveled internationally and appeared at industry tradeshows as a subject matter expert, and he regularly provides guidance for case teams on topics including forensic collection workflows, defensible artificial intelligence use, and production best practices.

Brandon has been a contributing member to award-winning Product Development teams and has worked to implement advanced analytics, predictive coding, and quality of life improvements for his clients. He has also created documentation, marketing and training videos, and websites for many of today’s leading eDiscovery applications.

Born in Minnesota, when he isn’t working with his clients, Brandon enjoys traveling to warmer climates with his wife, daughter (8), and son (4).

Matthew Samet:

Matt began his legal career in New York in 2004, transitioning to a focus on e-discovery in 2007, while working as part of the Discovery Attorney Team at Willkie Farr and Gallagher. Upon moving to Minnesota in 2012, Matt began his legal technologies and services project manager career, where his ability to foster relationships with highly sophisticated clients and oversee projects at the program level led to his promotion to Portfolio Manager where he regularly set up account level SOPs and Best Practice Playbooks. Matt came to TransPerfect Legal in January 2022, with the perspective of someone who has worked on both the law firm and vendor side of the e-discovery industry - he can frame ideas and concepts in a way that is digestible by all audiences. Matt is an early adopter of new technologies and has been at the forefront of onboarding clients to new offerings TransPerfect releases, whether it be with homegrown technologies or partnering with our technology partners.
